Terms of Service

The agreement for using mykeep — including the one consequence that cannot be undone.

Read this first: there is no password recovery. Your vault is encrypted with a key derived from your master password. We do not hold that password, we do not hold a copy of the key, and we have built in no backdoor, no reset link, and no override. If you lose your master password, your vault is permanently and irreversibly unrecoverable — by you, by us, and by anyone else. This is the deliberate property that makes the product safe, and it is not something we can make an exception to, however sympathetic the circumstances. Write your password and your recovery phrase down and keep them somewhere safe.

1. Agreement

These terms are between you and Domu Inc. and govern your use of the mykeep app, browser extension, desktop helper and gateway service (together, the "Service"). By using the Service you accept them. If you do not accept them, do not use the Service.

3. No recovery, and what follows from it

Section 3 restates the box above because it is the single most important term here. The Service is designed so that we cannot access your vault. Consequently we cannot restore access, decrypt your data, reset your password, or recover a lost recovery phrase, and we are not liable for any loss of data or access resulting from a lost password, a lost recovery phrase, a lost or wiped device, or a device failure. Keeping your own backups of your password and recovery phrase is your responsibility.

Optional multi-device sync stores only ciphertext we cannot read. It is a replication convenience, not a backup service, and it does not protect you against a lost password.

4. Acceptable use

You agree not to use the Service to store or transmit material unlawfully, to access accounts or systems you are not authorized to access, to attack, overload, or attempt to circumvent the rate, abuse or capacity limits of the Service, to resell or provide it as a service to third parties without our written agreement, or to reverse engineer the proprietary components except where that right cannot lawfully be restricted. Parts of mykeep are published under an open-source license; your use of those parts is governed by their own license terms.

5. Availability

The gateway is a relay. If your phone is asleep, offline, or declines a request, that request fails by design rather than being answered from a cache. We provide the Service "as available", may change, suspend or discontinue features, and may apply limits necessary to protect the Service and its users. We do not promise uninterrupted or error-free operation.

6. Fees

Individual use is currently offered free of charge. Paid plans, if and when offered, will have their pricing and billing terms presented at purchase. We may change pricing prospectively with notice.

7. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be secure, uninterrupted, or free of error. No security product can guarantee against every attack, and we make no such guarantee. We publish the security-critical source so you can verify our design claims for yourself.

8. Limitation of liability

To the maximum extent permitted by law, Domu Inc. will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow certain exclusions or limitations; in those places the above apply only to the extent permitted, and nothing here limits liability that cannot lawfully be limited.

9. Indemnity

You agree to indemnify and hold Domu Inc. harmless from claims arising out of your unlawful use of the Service or your breach of these terms.

10. Termination

You may stop using the Service at any time by deleting the app, which deletes your local vault. We may suspend or terminate access for breach of these terms or to protect the Service and its users. Sections 3, 7, 8 and 9 survive termination.

11. Changes

We may update these terms; material changes will be posted here and noted in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules, and the courts located there have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.
